The Lone Whacko? DOJ confident Ivins was the sole anthrax mailer.


The DOJ made their files against Bruce E. Ivins public today, and of course the question on everyone's mind is, is their case conclusive on the contention that Ivins acted alone? The answer, of course is, no, it's not. Evidently there will never be a trial in the Amerithrax case: instead we just have the Department of Justice bringing its prosecution straight to the general public, skipping all that trial by jury of one's peers and presumption of innocence stuff.

"We are confident that Dr. Ivins was the only person responsible for these attacks," Jeffrey Taylor, the U.S. attorney for the District of Columbia, told reporters Wednesday afternoon. ... Taylor said prosecutors are "confident" they could have proved their case against him.

The Times run-down uses the word "circumstantial" several dozen times, with some fairness -- the DOJ can arguably show physical evidence leading back to Ivins' home and laboratory (including the anthrax powder itself), but a far weaker case that has connects him with that evidence, weaponizing anthrax and dropping it in the mail.

Of course Greenwald's all over the story like stink on rice.

No time for analysis now, but I'll jump in with updates later. Thought I'd get the ball rolling.

A good deal of the evidence against him seems to be that he put in a lot of unexplained overtime prior to the attack (in August 2001), but with how bad the FBI botched Hatfill and Jewell I’ll take a wait and see attitude on this one. But until another suspect is named those that want to blame the VRWC for this need to throttle back-

We called the Frederick County Board of Elections today, now that they are open for business again, and the Deputy Election Director Noreen Schultz, the same person who called Kincaid back yesterday, confirmed to us that in fact Ivins was a registered Democrat since 1982. She said they only have voting records going back to 1996 in their database, but that, yes, Ivins "was a very regular voter" who had voted in every election, including Democratic Primaries, since that date.”

I agree the evidence against Ivins is not conclusive and given there will never be a trial, absent an independent investigation there is no real proof. So all we are left with in light of investigative efforts by the proven incompetent FBI overseen by a discredited Justice Department is speculation and uncertainty.

What is most conspicuously absent from these FBI documents is any real forensic evidence linking Ivins to the anthrax that was sent. That's particularly striking because the FBI took numerous swabs of Ivins' residence, his office space, his laboratory devices (presumably including the lyothilizer he used), his locker, his cars. If they had discovered any anthrax traces that genetically matched what was sent in 2001, they certainly would have said so. But they don't.

It's hard to imagine a total lack of physical evidence in a case like this. Either Ivins was some sort of mad genius who managed to produce weapons-grade anthrax without getting any traces of it on himself, or there is a lot more to this story.

Most likely, we'll never know. Everyone wants the case closed; therefore, it's closed.

they took the swabs at the time, and over a period of several years afterward. Ivins was always a suspect in the case.

So why, as Trav notes downthread, is it now suddenly obvious that he was the killer all along? The whole thing stinks.

I don't discount the possibility that Ivins did it (by himself). Stranger things have happened. But the pretense that this case has been fully resolved amounts to a coverup.

I'll tell you also what sticks out, the damned seven years!

Ivins sent an e-mail to a colleague a few days before the attacks that contained similar language, writing that "Bin Laden terrorists for sure have anthrax and sarin gas" and have "just decreed death to all Jews and all Americans," according to the affidavit.

Authorities began focusing on Ivins in 2007,

At one time I defended these institutions against calls to tear them down and start over.

Failure, failure, failure.

They've been sitting on this e-mail for 7 years and now it's suddenly relevant and conclusive?
